Terms of Service

These Terms are an agreement between you and Portico Technologies LLC ("we", "us"), a Florida limited liability company that operates IndieBrowser at indiebrowser.io (the "Service"). By using the Service or buying a game, you agree to these Terms.

1. Who can use IndieBrowser

  • You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these Terms and make or approve any purchase.
  • The Service is currently not offered in the European Union or the United Kingdom. You may not use tools such as a VPN to get around this.

2. Your account

You sign in with your email address; we send you a one-time sign-in link instead of using a password. Keep access to that email secure: anyone who can read it can sign in as you. Your purchases are tied to that email.

3. Buying games

  • Prices are in US dollars and shown before you pay. Payments are processed by Stripe; we never receive your full card number.
  • Your card is authorized at checkout and charged once we confirm the order. If we can't complete the order (for example, because of your location), the authorization is released and you are not charged.
  • Charges appear on your card statement under the IndieBrowser name.
  • All sales are final. See our Refund Policy.

4. What you get: a license, not ownership

When you buy a game, you receive a personal, non-exclusive, non-transferable license to play it through IndieBrowser for your own non-commercial use. Games belong to their developers, who license them to us for sale. You may not:

  • copy, download, extract, save or redistribute a game's files, or play them outside IndieBrowser;
  • share your account or sign-in links, or resell or transfer a game;
  • reverse engineer, modify, or circumvent any access control on the Service or a game, except as the law expressly allows;
  • use bots, scrapers or automated tools on the Service, or interfere with its operation or security.

We may suspend or revoke access to games used in breach of this section.

5. Early Access games

Games marked Early Access are unfinished. They may have bugs, change substantially, lose or reset progress, or never reach a final release. Buying an Early Access game gets you the game as it is today plus the updates its developer chooses to release. Developers decide their own roadmaps; we don't guarantee any feature or release date.

6. Saves and availability

Game saves are stored in your web browser, not on our servers. Clearing your browser data, using private browsing or switching browsers or computers may lose your progress. We work to keep the Service available but don't guarantee uninterrupted access. If a game is removed from sale, we aim to keep it playable for people who bought it, but can't guarantee this forever.

7. Ratings

Players who own a game may rate it with a thumbs up or down. We show only the number of recommendations publicly. Written reviews and comments are not accepted while a game is in Early Access. You must not post ratings or reviews that are fake, paid for, or abusive, and we may remove any that are.

8. Developers' content

Games, store pages and media are provided by their developers, who are responsible for them. If you believe something on IndieBrowser infringes your copyright, see our Copyright & DMCA policy.

9. Chargebacks and suspension

If you dispute a payment with your bank, access to that game is suspended while the dispute is open, and removed if the payment is reversed. We may suspend or close accounts that break these Terms, commit fraud, or abuse the Service.

10. Disclaimers

The Service and all games are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don't warrant that any game will run on your device or be free of errors.

11. Limitation of liability

To the fullest extent permitted by law, Portico Technologies LLC and its members, contractors and partners are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, saves or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $50, whichever is greater.

12. Indemnity

You agree to cover Portico Technologies LLC's reasonable costs, including legal fees, from claims arising out of your breach of these Terms or your misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, please contact us at support@indiebrowser.io and give us 30 days to try to resolve it. Any lawsuit must be brought in the state or federal courts located in Volusia County, Florida, and you and we consent to their jurisdiction. Either party may bring a claim in small-claims court instead where it qualifies.

14. Changes

We may update these Terms. If we make material changes, we'll update the date below and, where appropriate, notify you by email. The version you agreed to at checkout governs that purchase.
